Compliance to Section 13 of the SWM Act of 2022 - EPR

The National Environment Management Authority (NEMA) conducted a virtual sensitization session on Wednesday, 23rd August 2023. This sensitization session targeted producers on compliance with Section 13 of the Sustainable Waste Management Act of 2022 on Extended Producer Responsibility (EPR). The Ministry of Environment, Climate Change & Forestry spearheaded the development of the Sustainable Waste Management (SWM) Policy (2021) and SWM Act 2022 to transition waste management to the circular mode. Section 13 of the SWM Act, 2022 directs all producers to implement mandatory EPR obligations to prevent pollution from their products or by waste arising therefrom either individually or collectively in a compliance scheme such as KEPRO.
Following the 2-hour meeting conducted by NEMA, all producers are to rethink about the products they introduce into the Kenyan market to ensure they are safe. Further to this, NEMA officers will initiate inspections and enforcement for compliance within two months.
As the packaging for the non-hazardous products Producer Responsibility Organization (PRO), KEPRO will, on behalf of our members, submit a plan to the Authority, implement EPR obligations and have a cordial working relationship with counties in terms of the development of workplans and progress reports to NEMA.
A producer is defined in the Act as an entity that introduces goods, products and packaging into the country using authorized means by manufacturing, importing, converting, filling, refilling, repackaging or rebranding. KEPRO's membership is open to all producers in the plastics, paper & carton, glass, metals, and composite packaging.

Steps for Becoming a KEPRO Member:
- Apply as a KEPRO member here: https://membership.kepro.co.ke (prorated membership fees for 2023).
- After review of your application, the Proforma Invoice (PFI) will be shared via the registered email.
- Make the payment and upload the payment receipt via the link on the PFI email.
- Upon confirmation by the Finance team, the tax invoice and membership certificate will be shared via email.
Steps for Submitting your EPR Plan to NEMA:

- Answer Questions 1 to 4 of the notice
- Submit your EPR plan (hard copy) to NEMA Headquarters by 30th October 2023 while retaining a stamped copy
